Secondly, this hadith fails to present to us when mutah banned if it was!

First few hadiths provide evidence that mutah was temperarily banned on either the battle of khaybar or hunayn.

I will also prove that mutah was banned by prophet mohammad (sawa) temperarily.

until umar decided to take action in his own hands. yes Umar prohibited mutah.

Sahih Al bukhari v5 hadith4216

Narrated ‘Ali ibn abi talib’: On the day (of the battle) of khaibar, Allahs messenger forbade the muta (ie temporary marriage) and the eating of the meat of donkeys.”

Keep in mind khaybar is the 7th year AH. What if I prove that mutah was practiced after khaybar? Lets find out.

Sunan An-nasa’I V3 p127 h3364

It is narrated on the authority of Ali Ibn Abu Talib that he said: The messenger of Allah (sawa) forbade the enjoyment of women (through contracting temporal marriage) on the day of (the holy battle of) khaybar. Ibn Al-muthanna said: This was on the day of (the battle of) Hunain. He further said: As such Abd Al-wahhab told us from his book.

So mutah was banned in khaybar or hunayn which was after khayba??

Sunan Abu Dawud V2 p515 h2072

Az-Zuhri narrated: “we were in the company of ‘Umar bin abdul-aziz, and began discussing Mutah with women. A person by the name of Rabi bin sabrah said: ‘I testify that I heard my father say, that the messenger of allah (sawa) forbade it during the farewell Pilgrimage.”

So what is it, khaybar, hunain or the farewell pilgrimage? Or could it be that mutah was temporarily banned only on khaybar? Lets find out

Sahih Muslim V4 p20 h[3410] 11 – (1404)

'Abdullah said: "We were on a campaign with the Messenger of Allâh, and we had no women with us. We said: 'Why don't we get ourselves castrated?' But he forbade us to do that, then he granted us a concession allowing us to marry women in return for a garment, for a set period of time." Then 'Abdullâh recited the verse: "O you who believe! Make not unlawful the Tayyibât (all that is good as regards foods, things, deeds, beliefs, persons) which Allah has made lawful to you, and transgress not. Verily, Allah does not like the transgressors.”

Sahih Muslim V4 p21 h[3412] 12

It was narrated from Ismâ'il with this chain (a Hadith similar to no. 3410). He said: "When we were young men, we said: 'O Messenger of Allâh, should we not get ourselves castrated?"" And he did not mention: "We were on a campaign."

Sahih Muslim v4 p21 h[3413] 13

Narrated that Jâbir bin 'Abdullah and Salamah bin Al-Akwâ' said: "The caller of the Messenger of Allah came out to us and said: "The Messenger of Allâh given you permission to enter into Mut'ah marriages with women.”

Sahih Muslim v4 p21 h[3414] 14

It was narrated from Salamah bin Al-Akwa' and Jabir bin 'Abdullâh that the Messenger of Allâh came to us and gave us permission for Mut'ah. [3414] 14 (…) It was narrated from Salamah bin Al-Akwa' and Jabir bin 'Abdullâh that the Messenger of Allâh came to us and gave us permission for Mut'ah.

Sahih muslim v4 p22 h[3415] 15

'Ațâ' said: "Jâbir bin 'Abdullâh came for 'Umrah and we went to him where he was staying, and the people asked him about various things. Then they mentioned Mut'ah and he said: 'Yes, we engaged in Mut'ah at the time of the Messenger of Allah, Abû Bakr and 'Umar." [3415] 15 (…) 'Ațâ' said: "Jâbir bin 'Abdullâh came for 'Umrah and we went to him where he was staying, and the people asked him about various things. Then they mentioned Mut'ah and he said: 'Yes, we engaged in Mut'ah at the time of the Messenger of Allah, Abû Bakr and 'Umar."

The companions of the prophet (sawa) engaged in mutah in his time, in the time of abu bakr, AND in the time of umar. Clearly nothing wwas prohibited until the second caliph took matters in his own hand.

Sahih muslim v4 p24 h[3420] 20

It was narrated from Ar-Rabî bin Sabrah that his father went out with the Messenger of Allâh

to conquer Makkah. He said: "We stayed there for fifteen thirty between night and day and the Messenger of Allâh gave us permission to engage in Mut'ah marriages with women. marriages with women. I went out with a man from among my people, and I had an advantage over him in terms of good looks, as he was almost ugly. Each of us had a Burd. But my Burd was worn out whereas the Burd of my cousin was quite new. When we reached the lower part of Makkah, or the upper part, we were met by a girl like a long- necked young camel. We said: 'Will you let one of us engage in Mut'ah with you?" She said: "What will you give me?' Each of us spread out his Burd and she started looking at the two men, and my companion saw her turning away from him. He said: "This man's cloak is worn out but my cloak is quite new.' She said: "There is nothing wrong with his cloak,' (she said this) three times or two times. Then I engaged in mutah with her, and I did not come out until the messenger of allah forbade it.”

THE CONQUERING OF MAKKAH was after the battle of khaybar.

I mentioned earlier that Umar ibn al-khattab forbade mutah? Here is proof for it brother.

SAHIH MUSLIM V4 p24 h[3416] 16

Jâbir bin 'Abdullâh said: "We used to engage in Mur'ah in exchange for a handful of dates or flour, for several days, at the time of the Messenger of Allâh and Abû Bakr, until 'Umar forbade it in the case of 'Amr bin Huraith."

UNTIL UMAR FORBADE IT

Sunan ibn majah v2 p105 212 h1963

It is narrated on the authority of Ibn Umar that he said: When Umar Ibn Al-Khattab became the caliph, he addressed the people saying: "No doubt, the Messenger of Allah "Allah's blessing and peace be upon him" had given us permission to enjoy (of women through temporary marriage) thrice (or for three days) after which he forbade it. By Allah! I do not know that anyone practices such enjoyment (of women through temporary marriage) while he is married but that I will stone him to death, unless he brings four (witnesses) to bear testimony that the Messenger of Allah "Allah's blessing and peace be upon him" made it lawful after he had forbidden it."

Umar ibn al-khattab lacks awareness that other companions practiced mutah, or it could be a case of pride and ego.

Islam the religion of peace? Umar ready to stone???? Subhanallah.

Sahih Muslim v3 p390 [3025] (1249)

Tt was narrated that Abû Nadrah said: "I was with Jâbir bin 'Abdullâh, and someone came to him and said: 'Ibn 'Abbâs and Ibn Az-Zubair differed concerning the two Mut'ah.' Jâbir said: "They did them both with the Messenger of Allah, then 'Umar forbade them to us, and we did not do them again."
