Bundestag: Legal Affairs Committee discusses extension of investigative powers
2024-11-06 | The CDU/CSU parliamentary group’s motion was prompted, among other things, by the apparently unexpected consequences of the new Cannabis Act for criminal prosecution.
Since the law came into force, courts no longer consider certain evidence, in particular chat messages from the provider Encrochat, to be admissible. In some cases, this has led to acquittals of defendants accused of the illegal importation of narcotics.
The German Association of Judges is now calling for the cannabis reform to be improved. Specifically, a paragraph of the Consumer Cannabis Act is to be included in the catalog of the Code of Criminal Procedure.
With its motion, the CDU/CSU parliamentary group aims to give investigators the necessary powers to investigate certain crimes. The Legal Affairs Committee is now examining this proposal to amend the Code of Criminal Procedure.
