(Analysis) Brazil’s Supreme Court scheduled a crucial March 25 hearing where a five-justice panel will decide if former President Jair Bolsonaro faces trial for alleged coup plotting.

Justice Alexandre de Moraes, who released the indictment Thursday, remains a central and controversial figure in the proceedings. The First Panel will evaluate charges filed by Prosecutor General Paulo Gonet against Bolsonaro and seven key allies.

These defendants include former ministers Walter Braga Netto, Augusto Heleno, Paulo Sérgio Nogueira, Anderson Torres, plus Congressman Alexandre Ramagem, former Navy commander Almir Garnier, and Lieutenant Colonel Mauro Cid.

Prosecutors accuse Bolsonaro of orchestrating a criminal scheme to prevent President Luiz Inácio Lula da Silva from taking office after his 2022 election defeat.

Gonet charges the former president with leading a criminal organization and attempting to overthrow democratic rule through a coordinated conspiracy.

Bolsonaro and his supporters vigorously contest these allegations, calling them political persecution designed to eliminate opposition.

His legal team formally requested Justice Moraes recuse himself, claiming he has direct interest in the case. The court rejected this motion.

The case has sparked international reactions. Elon Musk recently suggested potential US sanctions against Justice Moraes under the Global Magnitsky Act, asking whether Moraes holds assets in the United States.

Musk’s companies have clashed with Moraes over content moderation, with the justice blocking platforms in Brazil and imposing fines when they refused to comply with his orders.

Trump Threatens Tariffs on Brazil Over Judicial Controversies

President Donald Trump considers imposing tariffs on Brazil for what his team calls “left-wing judicial activism.” The Wall Street Journal reports Trump views Brazilian court actions as politically motivated persecution of opposition figures.

This threatens to disrupt US-Brazil trade relations worth $78.2 billion in 2024. Critics highlight what they view as an alarming concentration of power in Moraes’ hands.

He serves as both the rapporteur for cases against Bolsonaro and a judge who will decide on those same cases, raising concerns about separation of powers.

Some critics draw parallels between his actions and tactics used by Venezuela’s judiciary to silence dissent.

Brazil’s judiciary faces particular scrutiny due to its history of political entanglement. The controversial annulment of Lula’s corruption convictions by the Supreme Court in 2021 stands as a prime example.

This decision erased his 580 days in prison and restored his political rights just in time for the 2022 election, shocking many observers who viewed it as an extraordinary reversal that undermined anti-corruption efforts.

Brazil’s Judicial Crisis Draws International Attention

The controversy has attracted direct international intervention. Trump Media and video platform Rumble filed a lawsuit against Moraes in Florida over social media account suspensions.

Billionaire investor Bill Ackman has warned Brazil risks becoming “uninvestable” if judicial practices continue in their current direction.

Defense attorneys challenge the factual basis of all charges. Bolsonaro’s team expressed “shock” at accusations they call baseless, insisting he never endorsed actions against democratic institutions. They particularly question the reliability of Mauro Cid’s plea bargain testimony.

Gonet dismissed all procedural objections Thursday, affirming the panel’s jurisdiction and defending his indictment as properly detailed.

He emphasized that these charges reflect a comprehensive investigation into Brazil’s most serious democratic crisis since the military dictatorship ended.

Should the justices accept the charges, Bolsonaro becomes an official defendant facing criminal trial. The case represents a pivotal moment in Brazil’s ongoing struggle with political polarization and democratic resilience.
