The Washington Examiner’s Byron York suggested that Democratic lawmakers could make last-ditch efforts to prevent President-elect Donald Trump from returning to the White House, with these attempts becoming more “desperate” as January 2025 draws closer.
A week after the election, York cited how Democrats sought an effort “behind the scenes” in 2016 to prevent Trump from entering office and suggested new efforts using the Fourteenth Amendment, which prohibits one who engaged in insurrection against the United States from holding office, could be made in the wake of Trump’s second victory.

“And so I wouldn’t be surprised if there’s some sort of ‘Hail Mary’ thing with the 14th Amendment,” York, the Washington Examiner’s chief political correspondent, said on Fox News’s The Ingraham Angle. “Who knows what they might try, but they are clearly, I think, going to get very desperate as the weeks go by and January 20th gets closer.”
Beyond what Democratic lawmakers could do ahead of Trump’s inauguration date next year, York also assessed how the party currently lacks a leader following its election losses for both the White House and the Senate. York noted this leaves the question of who could be the party’s 2028 presidential candidate unanswered.
“If this is what we think will happen, they’re going to be completely aced out in the House and the Senate, and of course they won’t control the White House, there will be zero Democratic leaders in Washington,” York said.

Biden is planning to attend Trump’s inauguration in January next year, approximately two months after the two meet together Wednesday for a postelection meeting. The president-elect’s wife, Melania Trump, will not be joining her husband for this meeting.
Following his victory, Trump began assembling his Cabinet, which included asking Rep. Mike Waltz (R-FL) to be his national security adviser. Trump is also reportedly expected to name Sen. Marco Rubio (R-FL) as his secretary of state.
